Family Law - Pre-Nuptial Agreements
The increasing incidents of divorce and the effects
of the Courts redistributive powers on divorce have led to the to
the emergence of Pre-nuptial agreements, which are designed to protect
the separate property of either or both of the spouses on the dissolution
of the marriage. Although they are currently unenforceable under
English Law, they may be highly influential or even determinative
in a case. More importantly, they may become (retrospectively) enforceable
under English Law.
Therefore, it may be of benefit to obtain early advice if considering
getting married, in connection with entering into a pre-nuptial
agreement.
