Q. I got caught by a speed camera - I already have nine points on my licence. Will I automatically be disqualified from driving? I need my car to take my children to school.
A. Accumulating 12 or more penalty points will render you liable to disqualification under the totting up procedure for a minimum period of six months unless you can establish that such a ban would cause you exceptional hardship. An experienced solicitor could help you to mount an exceptional hardship argument before the court. Being unable to take your children to school is unlikely to amount to exceptional hardship on its own, but if there would be a significant level of disruption to their education or if other adverse consequences would flow from the ban then you may have a realistic chance of saving your licence.
