Q: I have recently been involved in a car accident. I have sustained an injury and have been advised by my insurers that I should use their choice of Solicitor. Am I obliged to use their Solicitor? I do feel under some pressure to accept their choice of Solicitor.
A. You can choose whoever you wish to present your claim for compensation arising out of a road traffic collision. You should not feel that you have to accept your insurer’s choice. The insurer will often have a financial interest in the firm that they recommend which you may feel then provides a conflict of interest.
It is highly unlikely that your insurer’s firm of Solicitors will be locally based. You are perfectly entitled to instruct the Solicitor of your choice and may well feel more comfortable instructing a Solicitor that you can come and visit, get to know and have a “face to face” relationship.
